What is the process of getting a divorce through a solicitor?
Rowberry Morris’ divorce lawyers can guide you through each step of the divorce process, streamlining it and anticipating any delays in order to get matters resolved more efficiently and at less expense to you. The main stages are:
- An initial consultation – where you will meet with a solicitor who can help you understand your situation, advise you on your legal rights, and walk you through the process ahead of you.
- The application is drafted – your solicitor will prepare the divorce application and ensure that it is accurate and specific.
- A draft copy of the application and covering letter is sent to the other party (after they have been approved by you)
- The application submitted through the correct HMCTS portal.
- The application is served – once the application is filed, a formal copy will be sent to the other party (also called ‘the respondent’), who will then acknowledge receiving it.
- There is a cooling off period – You must then wait 20 weeks before you can apply for the Conditional Order, which used to be known as a Decree Nisi.
- The Final Order is applied for – After another six week waiting period, you can apply for the Final Order, at which point the marriage is legally ended.
What are the grounds for divorce in the UK, and how does a solicitor assist?
As of April 2022, the UK follows what’s known as a no-fault divorce system, meaning that you do not need to cite a specific reason for the breakdown of the marriage. All you have to do to qualify for a divorce is state that the marriage has irretrievably broken down.

In most cases, you can get a divorce without attending Court. Your divorce lawyer will oversee all of the filings and communication via the online Court system, handling matters with discretion and sensitivity to your time and expenses. Wherever possible, we will keep formal involvement to a minimum.
It is more likely that a Court will be necessary when there are disputes over finances or children, or other issues where you and your former spouse cannot reach a resolution. In the rare case that the respondent contests the application, working with a Court could also be needed in order for an agreement to be reached.

To begin the divorce process, your solicitor will help you to put together all of the following documents:
